Record $6M settlement in motorcycle crash lawsuit |

A man and his teenage daughter were awarded a record $6 million in a lawsuit settlement stemming from a 2006 crash in which they were struck by a truck while riding a motorcycle in southwest suburban Joliet.
The settlement is a record for a personal injury case in Will County, according to a release from the law office of Cogan & McNabola. The accident happened in 2006 when Richard Wright and his 15-year-old daughter Kelly Wright were riding a motorcycle in Joliet. Another driver, John Martis, was driving a Chevrolet truck when he attempted to turn left at a stop sign and struck the motorcycle, the release said.
Richard Wright suffered numerous injuries, including a fractured wrist and ankle, which required surgery, the release said. Kelly Wright sufferd a severely broken left ankle and a severe right tibia fracture. She is scheduled for fusion surgery on her ankle later this year.
The case was presided over by Judge Michael Powers. |

Patients seeking class-action lawsuit |

A Summersville attorney said several former patients of Know Pain Clinic in Beckley are prepared to file a class-action lawsuit against the clinic.
Attorney Bill McCourt said he's spoken with around 12 patients who have been unable to find new doctors since the clinic closed around the end of August or beginning of September.
"They're generally getting the type of medication that a lot of doctors have been sued in the past for dispersing," he said. "Doctors don't just want to bring you in and give you this type of medicine.
"They want to make sure the people they're giving the medicine to is who is getting the medicine," he added. "It's the type that's resellable." According to McCourt, Know Pain patients who really need the medication are harmed by the stereotypes and by the clinic closing.

Citi Sues Morgan Stanley Unit For $245M Over CDS Pact |

Citigroup Inc. (C) sued a Morgan Stanley Inc. (MS) Friday for allegedly breaching a credit-default swap agreement, saying it is owed more than $245 million.
The lawsuit, filed in U.S. District Court in Manhattan, alleges Morgan Stanley & Co. International PLC failed to live up to its obligations regarding a 2006 credit-default swap agreement.
The CDS agreement was designed to hedge against losses that Citigroup's Citibank unit might suffer related to a $366 million revolving credit facility that Citibank entered into with a collaterized debt obligation known as Capmark VI, according to the lawsuit.
Citibank paid Morgan Stanley $750,000 in quarterly payments for the risk protection provided by the CDS agreement, according to the complaint.
The CDO was scheduled to mature in 2038, but its performance "declined substantially" after July 2006 as a result of the global financial crisis, according to the lawsuit.
